1. Konu

Bu koşullar, yukarıdaki satıcı (“biz”) ile siteyi kullanan kişi (“sen”) arasında, kişiye özel dijital hediye sayfası hizmetinin satışına ve kullanımına uygulanır. Sipariş verdiğinde bu koşulları kabul etmiş olursun.

2. Hizmetin kapsamı ve ücret

Hizmet, senin hazırladığın içeriğin (fotoğraf, metin, şarkı bağlantısı) internette yayınlanan özel bir sayfaya dönüştürülmesidir. Fiziksel ürün gönderimi yoktur.
Ücret, sayfa başına tek seferlik ₺600’dir. Abonelik ve yenileme ücreti yoktur. Türkiye dışından verilen siparişlerde ücret dolar olarak alınır.
Sayfa yayına girdikten sonra içeriği dilediğin kadar güncelleyebilirsin; güncelleme ücretsizdir.
Sayfayı hazırlamak ve önizlemek ücretsizdir; ödeme yalnızca yayınlama aşamasında istenir.

3. Ödeme

Ödeme kredi/banka kartıyla alınır. Sipariş oluşturduğunda ödeme seçenekleri ve sana özel bir sipariş kodu gösterilir; aynı bilgiler e-postana da gönderilir.
Kartla ödeme, ödeme hizmeti sağlayıcısı Shopier’in güvenli ödeme sayfasında alınır. Kart bilgilerin Shopier tarafından işlenir; bu sitede kart bilgisi istenmez, saklanmaz ve işlenmez.
Ödemeni doğru eşleştirebilmemiz için sipariş kodunu ödeme sırasında sipariş notuna yazmanı rica ederiz.

4. Teslimat

Kartla ödemen onaylandığı anda sayfan otomatik olarak yayına alınır. Nadiren yaşanabilecek teknik gecikmelerde sayfanı en geç 24 saat içinde elle yayına alırız.
Teslimat, sayfanın yayına alınması ve link ile QR kodun e-posta adresine gönderilmesiyle tamamlanır.
E-posta adresini yanlış yazdıysan bize ulaşman yeterli; linki yeniden göndeririz.

5. Sayfanın yayında kalma süresi

Sayfanı süresiz yayında tutmayı hedefliyoruz. Her hâlükârda yayında kalma süresi satın alma tarihinden itibaren 24 aydan az olamaz. Hizmeti sonlandırmamız gerekirse en az 30 gün önce e-posta ile haber verir ve içeriğini sana iletiriz.

6. İptal, cayma ve iade

Sayfa yayına alınmadan önce siparişini iptal edebilirsin. Ödeme yapmışsan tutarın tamamı, talebinden itibaren 14 gün içinde aynı hesaba iade edilir.
Sayfa yayına alındıktan sonra, Mesafeli Sözleşmeler Yönetmeliği’nin 15/1-(ğ) maddesi uyarınca (elektronik ortamda anında ifa edilen ve tüketiciye anında teslim edilen gayrimaddi mallar) cayma hakkı kullanılamaz.
Bunun istisnası: sayfa bizden kaynaklanan bir hata nedeniyle çalışmıyorsa ve makul sürede düzeltemiyorsak, ücretin tamamını iade ederiz.
İade taleplerini e-posta ile iletebilirsin; iade, ödemeyi yaptığın hesaba yapılır.

7. İçerik sorumluluğu

Yüklediğin fotoğraf ve metinlerin sorumluluğu sana aittir. Başkasının fotoğrafını ya da eserini, izni olmadan yayınlamamalısın.
Hakaret, nefret söylemi, müstehcenlik, üçüncü kişilerin özel hayatını ihlal eden ya da hukuka aykırı içerikler yayınlanamaz. Böyle bir içeriği bildirim üzerine ya da tespit ettiğimizde yayından kaldırırız; bu durumda ücret iadesi yapılmaz.
Şarkılar YouTube ve Spotify üzerinden gömülü olarak çalınır; müzik dosyası tarafımızca barındırılmaz ve bu platformların kendi kuralları geçerlidir.
İçeriğini yalnızca hizmeti sunmak için kullanırız. Sayfanı tanıtım amacıyla kullanmayız.

8. Sayfanın gizliliği

Hediye sayfaları arama motorlarına kapalıdır; yalnızca linke sahip olanlar görebilir.
Şifre koruması açarsan sayfanın içeriği, doğru şifre girilmeden sunucudan hiç gönderilmez.
Düzenleme linkin sana özeldir; paylaşırsan sayfanı değiştirme yetkisini de paylaşmış olursun.

9. Hizmetin kesintisiz olmaması

Sayfalar üçüncü taraf altyapılarda (barındırma, e-posta, müzik platformları) yayınlanır. Bakım, arıza ya da bu hizmetlerdeki kesintiler nedeniyle geçici erişim sorunları olabilir. Uzun süreli bir kesintide bize ulaşman yeterli.

10. Uyuşmazlık

Bu koşullara Türkiye Cumhuriyeti hukuku uygulanır. Tüketici sıfatındaysan, Ticaret Bakanlığı’nca ilan edilen parasal sınırlar çerçevesinde yerleşim yerindeki Tüketici Hakem Heyetine ya da Tüketici Mahkemelerine başvurabilirsin.

1. Scope

These terms apply between the seller above (“we”) and the person using the site (“you”) for the sale and use of the personalised digital gift page service. By placing an order you accept them.

2. The service and the price

The service turns the content you prepare (photos, text, song links) into a private page published on the internet. Nothing physical is shipped.
The price is a one-time ₺600 per page. There is no subscription or renewal fee. Orders from outside Türkiye are charged in US dollars.
After your page is live you can keep editing it at no charge.
Building and previewing a page is free; payment is only requested when you publish.

3. Payment

Payment is by credit/debit card. When you place an order we show you the payment options and your own order code, and send the same details by email.
Card payments are taken on the secure payment page of our payment provider Shopier. Your card details are processed by Shopier; they are never requested, stored or processed on this site.
You must add the order code to the order note while paying so we can match your payment.

4. Delivery

Your page is published automatically as soon as your card payment is confirmed. In the rare case of a technical delay, we publish it manually within 24 hours.
Delivery is complete when the page is live and the link and QR code have been emailed to you.
If you mistyped your email address, just contact us and we will resend the link.

5. How long the page stays online

We intend to keep your page online indefinitely. In any case it stays online for at least 24 months from the purchase date. Should we ever have to end the service, we will give at least 30 days’ notice by email and send you your content.

6. Cancellation and refunds

You may cancel your order before the page is published. If you have paid, the full amount is refunded to the same account within 14 days of your request.
Once the page is live, the right of withdrawal does not apply, as the service is an intangible good delivered instantly in electronic form (Turkish Distance Contracts Regulation, art. 15/1-ğ).
Exception: if the page does not work because of a fault on our side and we cannot fix it within a reasonable time, we refund the full amount.
Send refund requests by email; refunds go to the account the payment came from.

7. Your content

You are responsible for the photos and text you upload. Do not publish someone else’s photo or work without their permission.
Insults, hate speech, obscenity, content that violates someone’s privacy or is otherwise unlawful may not be published. We remove such content when reported or discovered, and no refund is made in that case.
Songs play embedded from YouTube and Spotify; we do not host music files and those platforms’ own rules apply.
We use your content only to provide the service. We never use your page for promotion.

8. Privacy of your page

Gift pages are closed to search engines; only people with the link can see them.
If you turn on PIN protection, the page content is never sent from the server until the correct PIN is entered.
Your edit link is private; sharing it also shares the ability to change your page.

9. Availability

Pages are published on third-party infrastructure (hosting, email, music platforms). Maintenance, faults or outages in those services may cause temporary access problems. If an outage lasts, just contact us.

10. Disputes

These terms are governed by the laws of the Republic of Türkiye. As a consumer you may apply to the Consumer Arbitration Committee or the Consumer Courts in your place of residence, within the monetary limits announced by the Ministry of Trade.
